In a statement made on January 30, 2023, the Biden administration announced that the COVID-19 public health emergency (PHE) will end on May 11, 2023. However, as PHE currently expires in April, there will be one additional renewal before ending on the same day as the COVID-19 national emergency.
This notification meets the administration's promise to provide at least 60 days' notice before the PHE's end. Flexibilities enacted under the PHE, such as telehealth and coverage rules, will be governed by extensions given by Congress and the Centers for Medicare and Medicaid Services and eventually phased out. For example, the Consolidated Appropriations Act 2023 continued the telehealth flexibilities, such as the site of service including the patient's home, through December 31, 2024.
